Oregon Ban the Box

On 6/25/2015, Oregon Governor Kate Brown signed HB 3025 adding Oregon to the list of states that have “Banned the Box.” The law makes it an unlawful practice for an employer to exclude an applicant from an initial interview solely because of a past criminal conviction. Employers are prohibited from requiring an applicant to disclose on an employment application or prior to an initial interview, if they have a criminal conviction. In cases where no interview is conducted, the employer cannot require an applicant to disclose until making a conditional offer of employment. The law does not apply if federal, state or local law requires the consideration of the applicant’s criminal history, law enforcement agencies or an employer in the criminal justice system or to an employer seeking a non-employee volunteer. The law becomes effective January 1, 2016.
