The Latest Form I-9 Updates You Need To See
On August 25, 2016, the Office of Management and Budget (OMB) issued its approval of the final version of the new Form I-9. Here are the details you need to know.
What is happening?
On November 24, 2015 the proposed changes to Form I-9 was initially posted by the U.S. Citizenship and Immigration Services (USCIS) for public review and feedback for 60 days.
What are the proposed changes?
While we cannot say for certain if these anticipated changes are final until the USCIS posts the final form (which they must do by November 22, 2016), we believe the updates are primarily focused on preventing form errors, and include new assistance tools for each field to assist the employee and the employer in the completion of the form.
Although we cannot say for certain if these changes are until the form posts, here are some of the bigger changes we believe might be coming based on the drafts that were being reviewed for open comment by the public:
- A new checkbox to indicate whether or not you used a preparer or translator, as well as the choice to use multiple preparers or translators for each section
- An adjustment to Section 1 proposing that some foreign national employees provide either their Form I-94 number or foreign passport information as opposed to both
- Amendments to Section 2 to put new information that employers currently must put in the form margins, such as H-1B portability, OPT STEM extensions and TPS extensions
- Differentiation between the USCIS and Alien Registration Number in Section 1
- Splitting up the instructions on the Form I-9 from the form itself
