Connecticut Salary Ban

On May 22nd, 2018, Connecticut Governor Dannel Malloy signed legislation which will prohibit employers from inquiring about a prospective employee’s wage and salary history.  The new law will take effect on January 1st, 2019. 

The new legislation will make it an unlawful practice for an employer to inquire or direct a third party to inquire about a prospective employee’s wage and salary history unless a prospective employee has voluntarily disclosed this information. This does not apply to an employment agency, employee or agent that pursuant to any federal or state law that specifically authorizes the disclosure or verification of salary history for employment purposes.

Existing law already prohibits an employer from the following:

  • Prohibits an employee from disclosing or discussing the amount of his or her wages or the wages of another employee of an employer that have been disclosed voluntarily by the other employee
  • Prohibits an employee from inquiring about the wages of another employee
  • Requires an employee to sign a waiver or other document that denies the employee the right to disclose, discuss or inquire about the amount of their wages or the wages of another employee that have been disclosed voluntarily by the other employee
  • Discharge, discipline, discriminate against or penalize any employee who discloses or discusses the amount of their wages or the wages of another employee that have been disclosed voluntarily by the other employee
  • Discharge, discipline, discriminate against or penalize any employee who inquiries about the wages of another employee of the employer
